Cultivate Festival

2022 Terms and Conditions

 

The Festival: Cultivate is a multi-day family friendly all ages farm to festival event celebrating local food and the best in Canadian music (the “Festival”). The Festival is organized by Cultivate Community Non Profit Services (the “Organizer”) with registered offices at 5 Bramley Street North, Port Hope ON. L1A 3K72. The Festival is a Rain or Shine Event.

Terms and Conditions: By purchasing a Festival ticket (a “Ticket”) (or attending using any other valid entry) you agree (on your own behalf and on behalf of your Child Ticket holders) to all the following terms and conditions (“Terms and Conditions”). The Terms and Conditions may be updated from time to time and updated information can be found at https://cultivatefestival.ca/.

Tickets/Entry/Re-Entry: A valid Ticket entitles the holder to attend the Festival on the relevant date(s) and at the relevant times as stated on the Ticket. No admittance without a valid Ticket.  No entry to the Festival after 9pm each night until the following day. Tickets are non-transferable. All ticket holders will be scanned, all attendees will be wrist-banded. Holders of Weekend Passes will be issued one wristband which must remain on the wrist for all days. Re-entry to the Festival is permitted, children must be accompanied by their parent/guardian.

Children: Children under 18 are free BUT DO REQUIRE A TICKET, YES EVEN BABES IN ARMS.   By purchasing a “Child” ticket, you are confirming that you are either the parent, legal guardian or nominated guardian of the teen or child for whom you are purchasing. Each adult attending can accompany up to a maximum of 3 Child Ticket holders. Child Ticket holders can only enter the Festival with the person who purchased their ticket (i.e. their parent, legal guardian or nominated guardian). Child Ticket holders must be accompanied by their parent/guardian at all times. Children’s areas will be available to provide children with some shady fun activities.  Please note all children must be supervised and cannot be left in the children’s area unattended.

COVID-19: The Festival Organizer requires all Festival participants to comply with Provincial and local health unit COVID-19 Guidelines in effect at the time of the Festival.  It is anticipated that these guidelines will dictate screening, mask wearing, social distancing and other protocols. Signage will be conspicuously posted.  Touchless transactions will be implemented at ticket scanning and elsewhere when possible to minimize any direct contact.

Alcoholic Beverages: Anyone wanting to purchase an alcoholic beverage will be required to present valid photo ID at the time of purchase. Maximum of four (4) tickets per person will be permitted at one time. A maximum of two (2) drinks be sold/served to one person at any one time. Please drink responsibly.

What is NOT PERMITTED at the Festival: No Coolers or outside alcohol - this is a licensed event. There are food and beverage vendors on-site so please, no outside food or beverages wherever possible. No structures of any sort (i.e. sun shelters or tents). No pets (Service animals excluded). No drones. No motorized or battery operated vehicles unless authorized. You will not be allowed to bring in glass or sharp items of any kind. Please leave all glass and sharp items at home or in the car and where necessary, decant drinks into plastic bottles or bin it. There are no exceptions.

Safety: Safety is of the utmost importance and we want everyone to have the most incredible time while being mindful of those around you. If you need assistance or know of someone in need of assistance please call 911 or contact our on-site security team, emergency personnel or Volunteers for immediate assistance. 

Photo/Video Consent: All Festival participants (on their own behalf and on behalf of their Child Ticket holders) consent to the collection and use of their images, audio and audiovisual recordings or livestreams and acknowledge these may be used (whether alone or coupled with other material) for promotional purposes on the Festival website, Facebook and/or Instagram pages and other social media accounts which are accessible by members of the public, in newsletters and publications as well as material distributed by the Organizer directly to members of the public and third parties including, without limitation, Festival participants, newsletter recipients, sponsors, community partners, funding agencies and the media. 

Right to Refuse Admission: The Organizer reserves the right to refuse admission to or eject any participant and may on occasion conduct security searches to ensure the safety of Festival participants. The Organizer shall be entitled to remove anyone from the Festival who is under the influence of drugs or excessive alcohol or who in the reasonable opinion of the Organizer is conducting themselves in a manner inappropriate to their continued attendance or fails to comply with COVID-19 guidelines and directives.  

Postponement/Cancellation: The scheduling of the Festival may be impacted due to the global COVID-19 pandemic.  Should the Festival be postponed or cancelled, information will be provided to obtain refunds, please note ticketing fees are not refundable.  Otherwise, Tickets are non-refundable.

Available Facilities: Please only use the washroom facilities provided, gender neutral facilities will be available. Please use the litter bins and recycling points provided. Do not pollute the land.

Volunteers: Please feel free to seek information or assistance from any of our Festival Volunteers who will be identified by bright • shirts with “VOLUNTEER” across their sky blue shirt.

 

Parking: Free parking will be available on the festival site.

Accessibility: Accessible washrooms are on-site. Please note that the Festival grounds are not fully accessible as they are somewhat uneven and grass covered. Please feel free to seek information or assistance from any of our volunteers. Accessible parking is available very close to the front gate. There will be a accessible drop off located right at the front gate. 

Merchandise: Festival merchandise & artist merchandise will be available for purchase near the Main Gate.

Social Media: The official hashtag for the event is "#cultivatefestival" and you can also post and share your photos and video at https://www.facebook.com/cultivatefestival/. Our Instagram account is https://instagram.com/cultivatefestival,_please tag us in your posts with @cultivatefestival.

ASSUMPTION OF RISK. THE TICKET HOLDER, ON BEHALF OF THEMSELVES AND THEIR CHILD TICKET HOLDERS, ACKNOWLEDGES AND ASSUMES ALL RISKS AND HAZARDS ARISING FROM OR RELATED IN ANY WAY TO THE FESTIVAL (WHETHER KNOWN OR UNKNOWN, AND INCLUDING, WITHOUT LIMITATION, RISKS OF PERSONAL INJURY, PROPERTY LOSS AND/OR DAMAGE, OR OTHER HAZARDS), ARISING OR RESULTING FROM ANY CAUSE WHATSOEVER, INCLUDING ALL INHERENT RISKS INCIDENTAL TO THE FESTIVAL AND THE NEGLIGENCE OF THE ORGANISER OR ITS AGENTS, AND WHETHER OCCURRING PRIOR TO, DURING, OR AFTER THE FESTIVAL.
