Terms and Conditions
1.1. Organiser shall mean Local Food for Local Good.
1.2. Festival shall mean the Cultivate event put on by the Organiser.
1.3. Guest or Guests shall mean holders of valid tickets admitted to the Festival.
1.4. Child or Children shall mean a person of age 0-12.
1.5 Parent shall mean the parent or legal guardian of a Child.
2. Entry to the Festival
2.1. Only holders of a valid ticket may be admitted to the Festival. Entry will only be permitted during the dates and times specified on the ticket.
2.2. Entry may be refused if any of the following prohibited items are in the possession of the ticket holder:
2.2.1. Illegal items;
2.2.2. Firearms, knives or other dangerous items;
2.2.3. Outside alcohol;
2.2.4. Pets or other animals excluding service animals;
2.2.5. Equipment designed for the taking of photographs or the recording of audio or video if not integrated into a personal electronic device;
2.2.6. Items made of glass, including bottles or other containers; and
2.2.7. Any other items prohibited by the rules established by the Organiser for the Festival.
2.3. Proof of age is required for all ticket holders. If a ticket holder is unable to produce identification to prove their age, the Organiser may refuse that person entry to the Festival.
3. Child ticket restrictions
3.1. Child tickets may only be purchased for Children aged 0-12. Child tickets may only be purchased by the Parent of the Child for whom it is purchased.
3.2. Children must be accompanied by the Parent who purchased their ticket. Any Child not accompanied by the Parent who purchased their ticket will not be permitted entry. Each adult can accompany a maximum of 3 Children.
3.3. While at the Festival, Children must be accompanied by a Parent at all times.
3.4. Children will not be permitted to leave the Festival without their Parent accompanying them.
4. Eviction of Guests
4.1. Guests may be removed from the Festival at the sole discretion of the Organiser if in its opinion they are:
4.1.2. In possession of any of the items prohibited for entry to the Festival;
4.1.3. Taking photographs or making video or audio recordings for any purpose other than personal, non-commercial use, whether using professional equipment or personal electronic devices such as cellular phones;
4.1.4. Behaving inappropriately, rudely, disorderly or in a way that has a negative effect on other Guests;
4.1.5. Breaking any of the rules established by the Organiser for the Festival;
4.1.6.Committing a criminal offence; or
4.1.7. Part of a group of people who are involved in any of the foregoing, regardless of individual actions.
4.2. Guests may be required to produce identification to establish their age at any time. If unable to produce identification the Guest may be required to leave or prohibited from purchasing alcohol.
5. Ticket Restrictions
5.1. Tickets will no longer be valid if they are:
5.1.1. Resold, exchanged or transferred without the written consent of the Organiser;
5.1.2. Altered, defaced or modified in any way; or
5.1.3. Used as prizes in competitions or lotteries without the written consent of the Organiser.
5.2. It is the responsibility of the purchaser to check their tickets for any errors and report these immediately to the Organiser. The Organiser shall not be responsible for any incorrect, invalid, lost or stolen tickets.
6.0. Festival Changes
6.1. The Organiser may establish rules for the Festival which may be changed at any time without notice to ticket purchasers.
6.2. The Organiser may alter or vary the programme or performer line-up at any time without notice and without any obligation to refund or exchange any tickets issued prior to that time.
6.3. The Organiser may alter the dates or times of the Festival at any time and without notice to ticket holders. No refund will be provided in the case of altered dates or times including postponement of the Festival.
6.4. If the Festival is cancelled prior to the beginning of the date and time that a ticket is valid, the purchaser shall be entitled to a refund for the ticket price. The purchaser agrees that they will not be entitled to any other compensation relating to the cancellation or any other damages arising therefrom.
7.Other Important Provisions
7.1. All rights to pictures and audio or video recordings generated at the Festival vest exclusively in the Organiser.
7.2. All Guests consent to having their pictures taken and being audio or video recorded while at the festival. All Guests further consent to the use of these pictures and recordings for marketing or other purposes by the Organiser or such other entities as the Organiser may grant such rights to.
7.3. GUESTS ACKNOWLEDGE AND ASSUME ALL RISKS ARISING FROM OR CONNECTED WITH THEIR ATTENDANCE AT THE FESTIVAL, INCLUDING WITHOUT LIMITATION ANY RISKS OF PERSONAL INJURY, PROPERTY LOSS, DAMAGES OF ANY KIND OR OTHER HAZARDS CONNECTED WITH THE FESTIVAL IN ANY WAY, INCLUDING INHERENT RISKS OR THOSE ARISING THROUGH THE NEGLIGENCE OF THE ORGANISER BEFORE, DURING OR AFTER THE FESTIVAL AND AGREE TO INDEMNIFY THE ORGANISER AND HOLD THEM HARMLESS IN RESPECT OF ANY CLAIM OR ACTION ARISING AS A RESULT OF THE FESTIVAL.
7.4. If any provision of these Terms and Conditions should prove void or unenforceable for any reason, including by operation of law, that provision shall be severed in a manner so as to cause the least impact to these Terms and Conditions and the remainder shall continue in full force and application.
7.5. All Guests and purchasers of tickets agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario for the resolution of any claim or action arising from or connected with the Festival in any way.
7.6. No commercial activities are permitted on the Festival site without the prior written consent of the Organiser, including, without limitation, any retail activities, any photography or audio or video recording or any provision of services. The Organiser may charge fees, place restrictions or refuse consent in its sole and unfettered discretion.
